BAKER V. OCWEN LOAN SERVICING, LLC, ET. AL. (LONG BEACH COURTHOUSE- CASE NO. NC044506):
Our clients entered into a modification agreement with their lender, Litton. Their loan was transferred to Ocwen and Ocwen claimed they were in default despite our clients making all payments under the loan modification.
Despite Ocwen accepting payments from them, Ocwen continued to inform our clients they were in default.
Eventually, Ocwen filed a Notice of Default and Notice of Trustee Sale scheduling their home for a foreclosure sale.
We advised our client’s to file the lawsuit to stop the foreclosure and enforce their rights under the modification.
