Plaintiffs entered into a modification agreement with their lender (Litton). Plaintiffs’ loan was transferred to Ocwen and Ocwen claimed Plaintiffs were in default despite Plaintiffs making all payments under the loan modification.
Despite Ocwen accepting payments from Plaintiff, Ocwen continued to inform Plaintiffs they were in default and eventually Ocwen filed a Notice of Default and Notice of Trustee Sale scheduling Plaintiffs’ home for foreclosure sale. Plaintiffs filed the lawsuit to stop the foreclosure and enforce their rights under the modification.
