BRIZUELA V. OCWEN LOAN SERVICING, ET. AL. (DOWNTOWN LOS ANGELES COURTHOUSE- CASE NO. BC496458):
Our client’s filed a Chapter 13 Bankruptcy to restructure their debts and become current on their mortgage.
They made their mortgage payments while in bankruptcy, on time, every month to their lender. Our clients’ loan was transferred to Ocwen and Ocwen sent them a loan statement indicating that they owed $47,726.68 in arrearages.
Our clients attempted to contact Ocwen regarding the discrepancy; however, Ocwen refused to work with them to clear up the arrearages issue.
We advised them to file their lawsuit to enforce their rights.
Outcome: Litigation settled. Specific settlement terms are confidential but out client received a $195,000 principal reduction.
