Our client obtained a trial period plan through the Home Affordable Modification Program (HAMP) from his prior loan servicer, Aurora Bank, FSB.
The Trial Period Plan required our client to make three modified monthly loan payments in order for his loan to be modified. Despite making the three payments as required by the trial period plan, Aurora Bank, FSB did not modify his loan.
Our client contacted our foreclosure attorney and we filed a lawsuit to stop foreclosure and to enforce his rights per the trial period plan, alleging claims for breach of contract and fraud.
Outcome: Litigation settled & our client kept their home and resumed mortgage payments. The client’s loan was modified with affordable monthly payments.
