On July 14, 2023, Mr. Ballai purchased a 2014 Audi RS7 from Hermosa Motors and was told at the time of purchase that the vehicle had no accidents and was “perfect”, as said by Zach a worker at the dealership. Nearly two weeks later, the check engine light turned on and Mr. Ballai had the vehicle towed to Audi of Van Nuys where it was determined that the vehicle was in need of substantial repairs and would most likely not pass a smog test.
Mr. Ballai attempted to work out the issues with the dealer directly but that proved to be unsuccessful as the dealer refused to take responsibility for the mechanical issues, even though they had sold a merchantable car. As a result of this, Mr. Ballai has revoked his ownership of the car and demanded a rescission of the sale.
